Notaries from Jan 1 to be able to register property as registrars

Notaries from January 1, 2016 will be able to register property as registrars without endorsing the registration as notaries, a senior lawyer at Poberezhnyuk and Partners law firm Alla Protsenko has said.

"From January 1, 2016 the revise law on the state registration of rights to immovable property and their encumbrances," she told Interfax-Ukraine.

The lawyer said that the organization system of the state registration of rights has been changed. Now the system will include the Justice Ministry of Ukraine and its territorial agencies, registrars of rights (executive committees of rural and town councils) and public registrars of rights to immovable property.

"Public registrars of rights to immovable property are notaries as well. Thus, from January 1, 2016 notaries will fulfill functions of public registrars," she said.

Protsenko said that earlier notaries had restricted powers in the area. Notaries were able to register property if they endorse the registration as notaries.

"Notaries will register property irrespective of the location of property," she said.
